On March 7, Senators Tom Harkin (D-IA) and Arlen Specter (R-PA) introduced the Community Choices Act (S. 799), which would give individuals who are eligible for nursing home services or other institutional care equal access to community-based services and supports. The bill would provide an increase in federal funds to help states develop their long-term care infrastructure and to enhance their ability to provide home and community-based services (HCBS).

Kinship Care:
The Kinship Caregiver Support Act (S. 661), was introduced by Senators Hillary Clinton (D-NY) and Olympia Snowe (R-ME) on February 16. According to a statement released by Sen. Clinton: "Grandparents and other relatives raising children often encounter a variety of unnecessary barriers, including difficulties enrolling children in school, authorizing medical treatment, maintaining their public housing leases, obtaining affordable legal services, and accessing a variety of Federal benefits and services. The Kinship Caregiver Support Act attempts to address the full range of difficulties facing kinship caregivers, by allowing relatives to become formal guardians while receiving some financial assistance. This bill will provide relative caregivers with the information and assistance they need to thrive as non-traditional families."

Elder Justice Act

NCOA is a Coordinating Committee member of the Elder Justice Coalition, a bipartisan, 525 member group which supports both bills.

The bills would:
Establish an Elder Justice Coordinating Council chaired by the Secretary of Health and Human Services and the U.S. Attorney General and would include the head of every federal agency that is involved with elder abuse, neglect and exploitation.

Establish an Advisory Board to the Coordinating Council that would have 27 private citizen members who are experts and advocates on the issues surrounding elder abuse, neglect and exploitation.

Award grants to establish and operate both stationary and mobile forensic centers and to develop forensic expertise pertaining to elder abuse, neglect and exploitation.

Provide a federal funding source for Adult Protective Services (APS) programs. Up to this point, there has not been dedicated federal money to support APS programs.

Require the Secretary of Health and Human Services to carry out activities that provide incentives for individuals to train for, seek and maintain employment in long-term care facilities and provides funding through 2011 to support these activities.

Address LTC staffing problems by establishing incentive grants to attract qualified staff, retain staff, training staff and management.

Require all adjudications of criminal violations by nursing facilities or employees to be reported, as well as consumer rights information, on the official Nursing Home Compare website

Improve the training of surveyors with respect to investing allegations of abuse, neglect and misappropriation of property in programs and long-term care facilities that receive payments under Medicare and/or Medicaid.

LTC Direct Care Worker Bill

The Direct Support Professionals Fairness and Security Act. The bill would amend Medicaid to provide funds to states to enable them to increase wages paid to direct care workers in long-term care. The goal would be to gradually increase the wages of direct care workers not employed by a state or local government so that it is equal to the wages paid to direct care workers who are employed by the state or local government. NCOA is analyzing the bill to determine whether to support it.
